Argentina: Bill Aims to Ban All Abortions

Argentine President Javier Milei's party, La Libertad Avanza, has tabled a bill to repeal the legalization of abortion. The current law, which allows abortions within the first 14 weeks of pregnancy, came into force three years ago.

This bill, presented two days ago, aims to repeal the law on abortion, adopted on December 30, 2020 and promulgated on January 14, 2021. The proposal aims to make abortion a criminal offense, punishing both the woman and those involved in the procedure.

More specifically, it would impose sanctions on women in most cases and aims to make Argentina's penal code more restrictive than that of 1921 by eliminating grounds related to health risk and rape.

The penalties would be 3 to 10 years in prison for those who cause a woman to have an abortion without her consent, and 15 years in the event of the mother's death. In the event of consent, the sentences would be 1 to 4 years, and 6 years in the event of the woman's death. Medical professionals involved in the crime would also be banned from practicing their profession.

Oscar Zago, government spokesperson in the Chamber of Deputies, said the current law implies “that one has the right to end the life of the unborn child.”

The chances of the bill passing are virtually zero. “No. Next question,” said Martín Yeza, a member of former President Mauricio Macri’s PRO party, whose votes would be key to approval for the bill.
